These terms of service represent the entire agreement between you and Afterwork and supersedes all prior understandings, agreements, and representations. By using the Service, you acknowledge that you have read, understood, and agree to be bound by these terms of service.
Afterwork provides custom courses to users through its website (“the Service”). The Service is available only to individuals who are 18 years of age or older. By using the Service, you represent and warrant that you have the right, authority, and capacity to enter into this agreement and to abide by all of the terms and conditions of this agreement.
You agree to use the Service only for lawful purposes. You agree not to take any action that might compromise the security of the Service, render the Service inaccessible to others, or otherwise cause harm to the Service or to the Afterwork company. You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials, whether publicly posted or privately transmitted, are the sole responsibility of the person from which such content originated.
You agree not to use the Service to upload, post, or otherwise transmit any material that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable. You agree not to interfere with or disrupt the Service (including accessing the Service through any automated means), or any servers or networks connected to the Service.
Invoicing for the Service will be on a monthly basis. Payment for the Service will be made through the payment gateway provided on the website. All payments are non-refundable.
Afterwork provides customer support for the Service through email and the contact form on the website. Support will be provided during normal business hours. Afterwork does not guarantee a response time for support inquiries and will not be liable for any damages arising from the use of the Service or the failure to provide support.
You may cancel your account at any time by sending an email to contact[at]afterwork.ai. If we determine that you have engaged in any prohibited usage or any other conduct that restricts or inhibits others from using and enjoying our services, we may cancel or suspend your account without notice.
We will cooperate with law enforcement and other third parties to enforce laws, intellectual property rights, and other rights. We may disclose information about you to law enforcement or other third parties if we determine that such disclosure is necessary to comply with the law or to protect the rights or interests of Afterwork or others.
We may store backup copies of our data and your data to protect against data loss or other technical issues. We may store backup copies for a limited period of time, and we will securely destroy such backups when they are no longer needed.
Our services are provided "as is," and we do not make any representations or warranties, express or implied, with respect to our services or any aspect thereof. We do not warrant that our services will meet your requirements or that they will be uninterrupted, timely, secure, or error-free.
In no event will we be liable for any damages arising from the use of our services, including but not limited to indirect, incidental, punitive, or consequential damages.
You agree to indemnify, defend, and hold harmless Afterwork, its affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, and expenses, including attorneys' fees, arising from your use of the Service or your breach of this agreement.
Any notice required or permitted under this agreement will be in writing and delivered via email to contact[@]afterwork.ai.
This agreement and any dispute arising from or relating to this agreement will be governed by and construed in accordance with the laws of the Republic of Kenya. The parties agree that the courts of Nairobi, Kenya will have exclusive jurisdiction over any dispute arising from or relating to this agreement.
The failure of Afterwork to enforce any right or provision in this agreement shall not constitute a waiver of such right or provision. If any provision of this agreement is found to be invalid, the parties agree that the remaining provisions of the agreement shall remain in full force and effect.
Any claim arising out of or related to the Service must be brought within one year after the claim arose; otherwise, such claim is permanently barred.
